<p>WASHINGTON (AP) &#8212; A conservative-leaning appeals court panel on Tuesday upheld the constitutionality of President Barack Obama&#8217;s health care law, as the Supreme Court prepares to consider this week whether to resolve conflicting rulings over the law&#8217;s requirement that all Americans buy health care insurance.</p>
<p>A panel of the U.S. Court of Appeals for the District of Columbia issued a split opinion upholding the lower court&#8217;s ruling that found Congress did not overstep its authority in requiring people to have insurance or pay a penalty on their taxes, beginning in 2014.</p>
<p>The suit in Washington was brought by the American Center for Law and Justice, a legal group founded by evangelist Pat Robertson. It claimed that the insurance mandate is unconstitutional because it forces Americans to buy a product for the rest of their lives and that it violates the religious freedom of those who choose not to have insurance because they rely on God to protect them from harm. But the court ruled that Congress had the power to pass the requirement to ensure that all Americans can have health care coverage, even if it infringes on individual liberty.</p>

<p>(Reuters) &#8211; Americans&#8217; opinion of President Barack Obama&#8217;s healthcare reform in October reached its lowest point since the law passed in March 2010, according to a monthly poll by the non-profit, non-partisan Kaiser Family Foundation.</p>
<p>The view of the law has been roughly evenly split since its passage, but in October 51 percent said they had an unfavorable opinion, while 34 percent said their opinion was favorable, poll results released on Friday showed.</p>
<p>In September, the split was 43 percent to 41 percent. And October&#8217;s gap is closest to the one the poll tracked in July 2010, when the division was 50 percent to 35 percent.</p>
<p>The gap widened largely because the law appeared to be falling out of favor with Democrats, whose support dropped to its lowest point of 52 percent from 65 percent in September.</p>
<p>Although Democrats were still much likelier to view the law favorably than Republicans or independents, the percentage of Democrats who said they and their families were better off under the healthcare law dropped significantly to 27 percent in October from 43 percent in September.</p>

<p>A new wrinkle has surfaced in the implementation of the federal health care law that critics argue will impose a significant penalty on women and marriage.</p>
<p>The law includes generous subsidies for the uninsured so they can afford to buy coverage in the new <a id="KonaLink0" href="http://www.foxnews.com/politics/2011/10/27/obamas-health-care-law-penalizes-marriage-analysts-say/#"><span style="color: blue;">insurance</span></a> exchanges that are part of the legislation.</p>
<p>But several analysts told Congress Thursday the nature of the subsidies has an odd effect.</p>
<p>&#8220;The way this bill is structured, there are disincentives for women to marry and disincentives for women to work,&#8221; said Diana Furchtgott-Roth, a senior fellow at the Manhattan Institute for Policy Research. &#8220;And for a bill that&#8217;s supposed to make Americans <a id="KonaLink1" href="http://www.foxnews.com/politics/2011/10/27/obamas-health-care-law-penalizes-marriage-analysts-say/#"><span style="color: blue;">healthier</span></a>, these disincentives are truly startling.&#8221;</p>
<p>Critics say that beginning in 2014, Americans will find it more advantageous to stay single than marry because it will be easier to afford health coverage.</p>
<p>Why? The new law provides generous subsidies for those without insurance so they can buy it on the new exchanges, but the subsidies are tied to one&#8217;s <a id="KonaLink2" href="http://www.foxnews.com/politics/2011/10/27/obamas-health-care-law-penalizes-marriage-analysts-say/#"><span style="color: blue;">income</span></a> level and there&#8217;s the rub.</p>

<p>The latest <a href="http://www.rasmussenreports.com/public_content/politics/current_events/healthcare/health_care_law" rel="nofollow">Rasmussen poll</a> of likely voters shows that, by a margin of 16 percentage points (54 to 38 percent), Americans support the repeal of Obamacare. Among independents, the margin is 30 points — 61 to 31 percent.</p>
<p>Moreover, Americans are becoming increasingly convinced that repeal is not only possible but probable. Fifty-eight percent of Americans now think that repeal is likely. Fewer than half as many (28 percent) think that it’s unlikely. Such confidence in the repeal movement represents a high-water mark to date:  Rasmussen writes that the tally of those who think it’s “at least somewhat likely” that Obamacare will be repealed is “the highest ever measured since the bill became law 19 months ago.”</p>
<p><a href="http://www.nationalreview.com/articles/280274/reconciliation-option-james-c-capretta" rel="nofollow">Jim Capretta explains</a> that Republican presidential candidates’ pledges to use the reconciliation process, if necessary, to repeal Obamacare, offers further reason for voters to believe in the prospects of repeal.  He writes,</p>
<p>“Reconciliation is a special legislative process established by Congress to provide for expedited [filibuster-proof] consideration of important budgetary legislation….</p>
<p>“Reconciliation didn’t play a small role in Obamacare’s passage, as has been suggested [by some of its supporters]. Without reconciliation, Obamacare <em>would not have become law at all</em>….</p>

<p>“It’s true that Obamacare includes some provisions that, on their own, might be considered non-budgetary, but not nearly as many as some may think. The entire machinery of the coverage provisions — the individual mandate, the Medicaid expansion, the employer requirements — is entirely fueled by federal money (in the form of both subsidies and penalties). Moreover, the state exchanges and the regulatory apparatus they are intended to impose are also financed by federal taxpayers. <p>The key is to have a president who would sign such a bill into law. Thus, the key to repeal — as it’s always been — will be to replace President Obama.</p>

<p>The Obama administration announced Friday that it has suspended one piece of the landmark health care law which the president signed last year.</p>
<p>Secretary of Health and Human Services Kathleen Sebelius told Congress in a letter that the CLASS Act, which was supposed to provide a new voluntary long-term care insurance program, was unworkable since no actuarially sound way could be figured out to run the program.</p>
<p>“I do not see a viable path forward for CLASS implementation at this time,” Sebelius said in her letter.</p>
<p>CLASS stands for “Community Living Assistance Services and Supports.”</p>
<h3>The CLASS Act was a significant piece of the health care bill because it helped make it deficit neutral over the first ten years after enactment, as estimated by the Congressional Budget Office. Thus CLASS helped garner the votes to help the bill pass.<br />

The report lays out a brutal look at how the Obama machine used taxpayer dollars and government power to spread propaganda during his push for government mandated healthcare legislation.</p>

<p>The first point I want to bring to light is the Andy Griffith TV commercial the administration spent $700,000 developing, producing and marketing in favor of Obamacare.  For those who don&#8217;t remember, I&#8217;ve posted the ad below.</p>

<p>Not only is the ad clearly propaganda, it&#8217;s not even accurate. In fact, <a href="http://www.nypost.com/p/news/national/house_andy_health_pitch_stays_BmsH2Z3fy2QmAPahUNS4GP"><strong>it&#8217;s a down right lie</strong></a>.</p>
<blockquote><p><em>But Republicans say the ad campaign goes well beyond general  explanations of Medicare benefits, and argues in favor of the  health-care law, whose repeal is favored by 59 percent of voters,  according to a poll.</em></p>
<p><em>The campaign&#8217;s &#8220;promise that &#8216;benefits  will remain the same&#8217; is just as fictional as the town of Mayberry,&#8221;  wrote Brooks Jackson of FactCheck.org.</em></p></blockquote>
<p>The second front in the report, relevant to the healthcare horserace, is the fact that <a href="http://www.foxnews.com/politics/2010/01/08/economist-contract-health-department-touting-reform/"><strong>the Department of Health and Human Services paid an economist almost $400,000 to work as a PR agent for the government agency</strong></a>. During his time on the clock for the taxpayers, economist Jonathan Gruber wrote a plethora of op-eds in favor of Obamacare. Not once did he disclose his government pay.</p>
<p>The report also states that Gruber actually testified before the Senate&#8230; in favor of Obamacare without disclosing the $400,000 he was receiving.</p>
<p>These two stories are old news in a way, but now they&#8217;re a part of a larger report put forth by a member of Congress. And that can&#8217;t be good for the Obama administration.</p>

<p>Obama&#8217;s economic recovery policy seems to be a simple plan of &#8220;the harder you work, the more productive you become, the more we&#8217;ll take from you and the less choice you&#8217;ll have.&#8221;</p>
